A brief summary of laws enacted by the Territorial Legislature relating to aeronautics in Hawaii.

 1414 May 1970A Bill for an Act Relating to Transfers from the Airport Revenue Fund. (HB 2042-70) Adds a new section that reads:

“Sec. 36- . Transfer from airport revenue fund. Any law to the contrary notwithstanding, there shall be deducted from time to time by the director of finance for the purpose of defraying the prorated estimate of central service expenses of government tin relation to the airport revenue fund five per cent of all receipts and deposits in the airport revenue fund after deducting therefrom any amounts pledged, charged, or encumbered for the payment of bonds or interest thereon during the current year, from which receipts or deposits no deduction of five per cent has previously been made. The deduction of five per cent has previously been made. The deductions shall be transferred to the general fund of the State and become general realizations of the State. For the purpose of this section, the term ‘any amounts pledged, charged, or encumbered for the payment of bonds or interest thereon during the current year’ shall include:

(1) amounts which are so pledged, charged or encumbered;

(2) amounts otherwise required to be applied to the payment of principal of and interest on revenue bonds or other revenue obligations; and(3) amounts required by law to be paid from the airport revenue fund into the general fund of the State to reimburse the general fund for bond requirements for general obligation bonds issued for airport purposes.

The director of transportation shall cooperate with the director of finance in effecting this transfer.”
151 23 June 1970 A Bill for an Act Relating to Airports. (HB 1596-70) Adds a new section to Chapter 261, HRS regarding arrest and citation for the violation of any provision in this chapter, including airport rules and regulations that have been adopted; gives enforcement officers the discretion of issuing a summons or citation for such violation. 
165 25 June 1970 A Bill for an Act Relating to Assistance for Displaced Persons, Families, Businesses and Non Profit Organizations in Airport Acquisition Program. (HB 1597-70) Chapter 261, HRS, is amended to add a new part on Airport Relocation which describes compensation and relocation assistance for displaced persons or businesses because of airport construction and replacement housing.  Applies to persons who are displaced as a result of proposed airport projects after September 1, 1969.
175 30 June 1970 A Bill for an Act Making Appropriations Out of the General Revenues and Approving Expenses from Other Sources for FY Ending 30 June 1971. (HB 1260-70) Appropriates $18,616,970 for administration, operations and maintenance of the State Airport System. 
180 30 June 1970 A Bill for an Act Relating to Taxation. (HB 1267-70)Amends Section 239-6, HRS to levy and asses upon each airline a tax of four percent of its gross income each year from the airline business. 
187 30 June 1970 A Bill for an Act Relating to Public Improvements and financing Thereof.  (SB 1131-70) Appropriates CIP Funds:

Kahului Airport, $5,730,000—Reconstruction of Runway 2-20 and parallel taxiway, installation of high intensity runway lights and medium intensity taxiway lights, marking and other misc. airfield improvements.

Molokai Airport, $210,000—Clearing and grading of airfield for improvements to drainage. Resurfacing of access road and parking lot. Expansion of apron. Misc.

Lanai Airport, $117,000—Construction of terminal extension for baggage claim area and covered walkway. Seal coating of runway, taxiway and apron pavement and misc.

Lanai Airport, $270,000—Plans to construct 2,000-foot minimum extension to existing runway, strengthen existing runway, expand and reconstruct apron.

Kahului Airport, $1.24 million—Construction of two-lane highway from Honoapiilani Highway near Maalaea to Hana Highway near Kahului.

General Lyman Field, $3.2 million—Construction of access roadway, lighting, utilities, relocation of National Guard facilities, land acquisition, alterations to cargo building, loading devices for overseas terminal, furniture, fuel system, misc.

Lihue Airport, $415,000—Misc. improvements to airfield and terminal; expansion of apron and other improvements.
18 March 1971 A Bill for an Act Relating to the Issuance of Revenue Bonds for the Financing of Airports and Air Navigation Facilities and Repealing Act 381, SLH 1949. (SB 179) Repeals Act 381, SLH 1949 authorizing the issuance of revenue bonds for airport facilities. 
68 18 May 1971 A Bill for an Act Making Appropriations for Research & Development, Investment and Operating Expenses for the FY July 1, 1971 to June 30, 1973 and Authorizing the Issuance of Bonds. (SB 1) Appropriates $37,744,142 for the administration of the State Airport System for biennium 1971-1973. Authorizes $56,000 for the Civil Air Patrol. Funds were also appropriated for O&M and Improvements:

Statewide Airport Planning, $300,000—airport studies, research and advance planning of airfield and terminal facilities.

Statewide Airport Certification, $1,053 million—Procurement of fire and rescue and other required equipment for the statewide system of airports and misc. airport improvements.

HNL, $18.920 million—Second phase construction of Runway 8R-261, paving, lighting and marking. Completion of international arrivals building, additional 747 gates and holding rooms, misc. terminal improvements, cargo facilities, airfield improvements and land acquisition. Alterations to ticket lobby, holding room, baggage claim, administration building, additional loading bridges of Y concourse; roads and parking improvements, sewer system at the south ramp and other misc. improvements.

General Aviation Airport, Oahu, $100,000—Construct taxiways and apron, t-hangars, terminal facilities and other misc. improvements. Design & construction.

Upolu Airport, $250,000—resurface runway.

Kahului Airport, $575,000—Grading, paving, landscaping & lighting access roadway, underground utilities and other improvements; construct new maintenance facilities.
160 30 May 1971 A Bill for an Act Relating to Powers of the Department of Transportation. (SB 210) Amends Chapter 261 by adding a new part titled Special Facility Projects. With the approval of the Governor, allows the DOT director to issue special facility revenue bonds up to $15 million; sets forth requirements for special facility leases and special facility revenue bonds. 
197 21 June 1971 A Bill for an Act Relating to General Public Improvements and the Financing Thereof.  (HB 4) Appropriates CIP funds:

Lanai Airport, $48,000—Extension of parking facilities, painting of terminal and cargo building.
14 17 April 1972 A Bill for an Act Relating to Rental Rates for flight School Certificated by the Federal Aviation Administration. (HB 1778-72) Amends Section 261-7 HRS relating to the operation and use privileges of airports for commercial purposes; allows Department to set fees and charges for rentals for buildings and land uses at rates not less than fifty percent of the fair market rentals of the buildings and land areas.

20 12 April 1973 A Bill for an Act Relating to Enforcement of Aeronautics Laws. (HB 1875) Section 261-17(a) was amended regarding the powers of enforcement officers. 
182 24 April 1973 A Bill for an Act Relating to Grant for Civil Air Patrol. (HB 1024) Section 261-6(b) was amended relating to expenses of the CAP. 
218 13 June 1973 A Bill for an Act Relating to the State Budget. (SB 1295) Appropriates funds for the administration of airport facilities and services. For the first time the budget for the various airports are separated by program number. HNL has 340.84 positions; General Lyman, 40; Keahole, 17; Waimea-Kohala, 2; Kahului, 33; Hana, 1; Molokai, 3; Lanai, 2; Lihue, 24; Bellows, 1; Dillingham, 1; Kalaupapa, 1. This is the first time there is an appropriation for the facilities and service at Ala Wai Heliport of $500,000, however there is no position.



Makes biennium CIP appropriations as follows:

HNL, $12.3 million—HNL Expansion Program.

38 24 May 1974 A Bill for an Act Relating to the Hawaii Penal Code. (HB 1733-74) Amends Section 708-836, Hawaii Penal Code, to include airplanes as propelled vehicles, and classes unauthorized control of a propelled vehicle as a Class C Felony. 
101 31 May 1974 A Bill for an Act Relating to Special Facility Revenue Bonds Issued by the Department of Transportation. (HB 2186-74) Amends Section 261-55 HRS relating to exceptions of the issuance of special facility revenue bonds.

235 9 June 1976 A Bill for an Act Relating to the Establishment of Developmental Rates for Facilities Used by General Aviation Activities. (SB 2267-76) Section 261-7(e) HRS was amended to read:

“(e) Buildings and land areas for general aviation activities; developmental rates. The department may from time to time establish developmental rates for buildings and land areas used exclusively for general aviation activities at rates not less than fifty per cent of the fair market rentals of the buildings and land areas and may restrict the extent of buildings and land areas to be utilized.”
29 5 May 1977 A Bill for an Act Relating to the Power of the Department of Transportation to Issue Special Facility Revenue Bonds. (SB 891) Increases the authorization of special facility revenue bonds from $15 million to $25 million. 
110 14 May 1977 A Bill for an Act Relating to Airport and Harbor Revenue Bonds. (HB 1687) Section 81 of Act 218, SLH 1973 was amended.  Section 93 of Act 195, SLH 1975 was amended.
142 1 June 1977 A Bill for an Act Relating to Registration of Vehicles. (HB 780) Amends Section 286-57 HRS, to add airplanes as being unlawful to remove from the State without the permission of the legal owner.
