(HB 17 Third Special Session) | Confers temporarily upon the governor certain powers to provide immediate relief to facilitate continuity of business activities and services, minimize employee layoffs, and prevent endangerment of public health, safety or welfare during a period of economic emergency. The Governor may suspend, waive or defer any contract obligations owed to the State up to April 30, 2002 due to the economic emergency, including airport concessions who meet certain requirements. Allows the Governor to waive airport landing fees and airport system support charges during the period of economic emergency. This Act shall be repealed on April 30, 2002. |

(SB 1224) | The major purpose of this Act is to 1) Give the Governor and DOT the discretion and authority to provide relief to airport concessionaires whose leases or contracts with DOT were entered into on or after November 1, 2006, and who spent capital improving the concession premises; or who, as a result of any agreement with DOT pursuant to Act 128 SLH 2006, or Act 201 SSH 2004, spent capital improvement on the concession premises; provided that negotiations for relief for a concession covered by this Act shall commence within 990 days, or any extension agreed to between the governor or governor’s designee and a concessionaire following the mailing by the concessionaire of a written request for relief to the governor; and 2) provide that in seeking relief pursuant to this Act, qualified concessionaires may only seek relief for losses of gross receipts or loss of business which occurred during periods of time starting November 1, 2006, or later. Takes effect on July 1, 2009 and will be repealed on July 1, 2011. |

(d) All moneys paid into the passenger facility charge special fund shall be appropriated, applied, or expended by the department for airport capital improvement program projects approved by the legislature and as permitted under the Aviation Safety and Capacity Expansion Act of 1990, codified as 49 United States Code Section 40117, as amended from time to time. (e) Any resolution or certificate authorizing any issue of bonds relating to the use of the passenger facility charge for an airport capital improvement program project approved by the legislature may establish other accounts within the passenger facility charge special fund and require the transfer of the passenger facility charge into the other accounts to pay debt service on the related bonds. |
