102 | 2010-05-12 | A BILL FOR AN ACT RELATING TO THE HAWAII TOURISM AUTHORITY | (1) Authorizing the HTA to maintain confidentiality of certain sensitive information; (2) Allowing information relating to marketing plans and strategies to be disclosed after the execution of the marketing plans and strategies; (3) Clarifying that HTA executive meetings shall adhere to the procedures established by chapter 92, Hawaii Revised Statutes; (4) Requiring the HTA to include in the measure of effectiveness of its marketing plan, documentation of the progress of the marketing plan towards achieving its strategic plan goals; (5) Requiring the HTA to periodically submit a report on its contracts and agreements, in conformity with HTA current practices; and (6) Extending for five years the statutory provisions that exempt HTA accounts from the supervision of the Comptroller, authorize the deposit of interest and revenues from projects and project agreements into the Tourism Special Fund, and authorize HTA to use up to five percent of moneys in the Tourism Special Fund for administrative expenses and pay the Executive Director up to nine percent of the funds authorized for administrative expenses. |

319 | 2012-07-10 | Fireworks; Aerial Luminaries Package | The purpose and intent of this measure is to make it unlawful to sell, offer for sale, distribute, possess, ignite, or otherwise use aerial luminaries, also known as sky lanterns, Hawaii lanterns, or flying luminaries. Written comments in support of this measure were received from the Maui Fire Department, County of Maui; and Kauai Fire Department, County of Kauai. Your Committee finds that imposing a ban on the aerial luminaries will protect the health and safety of the community and livestock. The aerial luminaries pose a fire threat because they are essentially open flame devices, which can land on vegetation, buildings, and power lines. The aerial luminaries can also cause death or serious injury to livestock when aerial luminary remains are consumed. Aerial luminaries have reportedly been banned in Georgia, Australia, and parts of Germany. Your Committee finds it appropriate to ban these devices in Hawaii. |

Your Committee finds that the Civil Air Patrol supports State Civil Defense and emergency management agencies in all of Hawaii's counties by performing vital emergency functions, which includes conducting tsunami warnings and performing search and rescue after disasters. This measure provides funding for the Civil Air Patrol to support its facilities and training for pilots and personnel. |

The legislature finds that the Supplemental Appropriations Act of 2016, Act 124, Session Laws of Hawaii 2016, item C-38.02, project adjustment fund, statewide, establishes a contingency fund for the airports division's project adjustment purposes, subject to the provisions of Act 124. However, Act 124, which amends Act 119, Session Laws of Hawaii 2015, does not contain a budget proviso that permits the utilization of the department of transportation, airports division, project adjustment fund. A budget proviso relating to the department of transportation, airports division, project adjustment fund is necessary to authorize the governor to make supplemental allotments from the project adjustment fund to supplement any currently authorized capital investment cost elements for airports division capital improvement projects. SECTION 2. Act 119, Session Laws of Hawaii 2015, as amended by Act 124, Session Laws of Hawaii 2016, is amended by adding a new section to Part VII to read as follows: "SECTION . If authorized appropriations specified for department of transportation, airports division, capital improvement projects listed in this Act or in any other act currently authorized by the legislature are insufficient, and where the source of funding for the project is designated as revenue bond funds, the governor may make supplemental allotments from the department of transportation, airports division, project adjustment fund appropriated in part II and described in part IV of this Act to supplement any currently authorized capital investment cost elements; provided that the supplemental allotments from the project adjustment fund shall not be used to increase the scope of the project; and provided further that the governor shall submit a report to the legislature of all uses of this authority for the previous twelve month period from December 1 to November 30 no later than thirty days prior to the convening of the regular session of 2018."
